Terms of Service

Last Updated: September 30, 2026

PLEASE READ THESE TERMS CAREFULLY. SECTION 12 CONTAINS AN ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTIONS AND JURY TRIALS. IT AFFECTS HOW DISPUTES BETWEEN YOU AND SUPRFI ARE RESOLVED. YOU MAY OPT OUT OF THE ARBITRATION AGREEMENT AS DESCRIBED IN SECTION 12.8.

1. Acceptance of These Terms

These Terms of Service (“Terms”) are a binding agreement between you and Home Services Financing Solutions, Inc. d/b/a SuprFi, a Delaware corporation (“SuprFi,” “we,” “us,” or “our”). They govern your access to and use of our websites, including www.suprfi.com and its subdomains, our online and mobile application flows, our borrower and merchant portals, and our text message, chat, email, and voice communications (together, the “Services”). By accessing or using the Services, you agree to these Terms. You also consent to receive these Terms and any notices or disclosures relating to the Services in electronic form. Your electronic signature, including a click-through acknowledgement, checkbox, or typed name, has the same legal effect as a handwritten signature.

2. Your Loan Documents Control

These Terms govern your use of the Services only. Any loan you obtain is governed exclusively by the loan documents you receive and sign for that loan, including your Consumer Loan Agreement, the disclosures for that product, your payment authorization, your Consumer Report Authorization, the SuprFi Privacy Notice, and your E-SIGN Consent (the “Loan Documents”). If these Terms conflict with the Loan Documents, the Loan Documents control as to that loan, and nothing in these Terms modifies the Loan Documents or limits any right you have under them or under applicable consumer protection law.

3. Eligibility

To use the Services and apply for financing, you must: (a) be at least 18 years of age with legal capacity to contract; (b) be a resident of a state where the product is offered; (c) be seeking financing solely for personal, family, or household purposes; and (d) have read and agree to these Terms. The Services are offered only in the United States, and not every product is offered in every state.

If you access the merchant portal or otherwise use the Services as a participating merchant or contractor, subsection (c) above does not apply to you, and your Merchant Agreement with SuprFi governs your use of the Services and controls over these Terms in the event of any conflict.

4. Your Account

When creating an account with us, you agree to provide accurate, current, and complete information. Providing false information may result in denial, revocation of an approval, and referral to law enforcement.

If you create an account, you are responsible for keeping your credentials confidential and your contact information current, and you are responsible for any and all activity under your account.

5. Electronic Communications

We use SMS text messaging, chat, email, and telephone to communicate with you about applications, loans, and servicing, including through automated systems. By providing a mobile number, you agree that we may contact you at that number for those purposes, as described in our Privacy Policy. Marketing calls and texts are sent only with the separate express written consent you provide in the application flow, which you may revoke at any time. Messages may include financing and monthly payment options, application links, application and loan status updates, payment reminders, and servicing and collection communications.

Your agreement to receive marketing calls or texts is not a condition of obtaining credit from SuprFi. Message frequency varies, and message and data rates may apply. We do not share mobile opt-in information or text message consent data with any third party for marketing purposes. Wireless carriers are not liable for delayed or undelivered messages.

Mobile and SMS Communications.

  • Text messages we send may include verification codes, application and loan status notifications, and other messages necessary to complete your transaction or otherwise provide the Services.
  • You may stop receiving text messages at any time by replying “STOP” to any message from us. We will send one confirmation message, after which you will receive no further texts other than those required by law or your Loan Documents. Reply “START” to resume, or “HELP” at any time for assistance.
  • For help with text messages, contact us at support@suprfi.com or (833) 736-4261.
  • To the fullest extent permitted by applicable law, and subject to Section 11, we are not liable for messages that are delayed or undelivered due to causes beyond our reasonable control. Nothing in this Section limits any notice or disclosure we are required to provide under your Loan Documents or applicable law.

6. Applying for Financing

  • No guarantee of approval. Submitting an application does not guarantee approval. All financing is subject to our credit and eligibility criteria, identity verification, and applicable law.
  • Terms are disclosed before you agree. Before you become obligated on any loan, we will give you the disclosures required for that product, stating the number, timing, and amount of payments and any interest, finance charge, or fees. Those disclosures and your Loan Documents, not these Terms or anything else on the Services, state the cost and terms of your loan. A current description of our products is available at www.suprfi.com/rates.
  • Prequalification is not a commitment. Prequalified or estimated terms are not an offer or commitment to lend; final terms depend on review of your completed application and may differ.
  • Credit reports. Consumer reports are obtained only as authorized in the Consumer Report Authorization presented separately in the application. We will tell you before any request that may affect your credit score.
  • Adverse action and fair lending. If we decline your application, offer different terms, or take other adverse action, we will provide a notice explaining your rights under the Equal Credit Opportunity Act and, where applicable, the Fair Credit Reporting Act. SuprFi does not discriminate on any basis prohibited by law.

7. Collections and Credit Reporting

You agree that we may send you payment reminders from time to time using the communication methods for which you have provided contact information and, where required, consent. If you fail to pay an amount owed under your Loan Documents, we or a third party may engage in collection efforts to recover those amounts, which may involve contacting you directly, referring your account to a collection agency, or taking legal action. You understand that SuprFi or any assignee may report information about your loan (such as on-time, late, and missed payments; any defaults; and the fact that you paid off your loan) to consumer reporting agencies, in accordance with the Fair Credit Reporting Act and your Loan Documents. FAILURE TO PAY MAY AFFECT YOUR CREDIT SCORE. Nothing in this Section limits your rights under the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Florida Consumer Collection Practices Act, or any other applicable federal or state consumer protection law.

8. Merchants and Home Service Providers

SuprFi provides financing. We do not perform home repair, home improvement, or other home services. Participating merchants and contractors are independent businesses. They are not our agents, employees, partners, or joint venturers, and they have no authority to make representations or commitments on our behalf, including about your loan terms, approval, or eligibility. We do not perform, supervise, inspect, guarantee, or warrant any goods or services a merchant provides, and we make no representation about a merchant’s licensing, insurance, workmanship, pricing, or fitness; your agreement for those goods or services is between you and the merchant. Participating merchants are required by their agreement with us not to charge you more for a financed transaction than they would charge for the same transaction paid in cash. If you have a problem with the goods or services, contact the merchant first and contact us as well at (833) 736-4261 or partners@suprfi.com so that we can assist. Nothing in these Terms waives or limits any right you have under the Notice of Claims and Defenses in your Consumer Loan Agreement or under applicable law.

9. Intellectual Property

The Services, including all software, content, text, graphics, designs, and the SuprFi name and logo, are owned by SuprFi or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-sublicensable license to use the Services for your own personal, non-commercial purposes or, if you are a participating merchant, for the business purposes permitted by your Merchant Agreement. All rights not expressly granted are reserved.

You may not, and may not permit others to: use any automated means, including robots, spiders, or scripts, to access the Services or collect information from them; engage in screen scraping or database scraping; frame the Services or place pop-up windows over any page; copy, modify, translate, reverse engineer, decompile, or create derivative works from the Services; remove any proprietary notice or mark; or access, use, or monitor the Services for benchmarking or competitive purposes.

If you send us questions, comments, suggestions, ideas, or other feedback about the Services, you agree that your disclosure is unsolicited and non-confidential, that it places us under no obligation, and that we may use and disclose it for any purpose without compensation or acknowledgement to you.

10. Disclaimers

Except as expressly stated in these Terms or your Loan Documents, and to the fullest extent permitted by applicable law, the Services are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the Services will be uninterrupted, secure, or error-free. Nothing on the Services is legal, tax, or financial advice. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and nothing in this Section limits any warranty or right that cannot be limited under applicable law.

11. Limitation of Liability

To the fullest extent permitted by applicable law: (a) SuprFi and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Services; and (b) our total liability to you arising out of or relating to your use of the Services will not exceed the greater of the total amount you paid to SuprFi for the Services, excluding payments made on any loan, in the twelve (12) months before the event giving rise to the claim and $500.

Nothing in these Terms limits or excludes our liability for death or personal injury resulting from our willful misconduct; fraud; our obligations or your rights under your Loan Documents; your rights under the Equal Credit Opportunity Act, the Fair Credit Reporting Act, the Electronic Fund Transfer Act, the Truth in Lending Act, the Military Lending Act, or any other consumer protection law; or any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Dispute Resolution; Arbitration; Class Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES BETWEEN YOU AND SUPRFI TO BE RESOLVED BY INDIVIDUAL ARBITRATION RATHER THAN IN COURT. YOU WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT WITHIN 60 DAYS AS DESCRIBED IN SECTION 12.8, AND OPTING OUT WILL NOT AFFECT ANY OTHER PART OF THESE TERMS.

12.1 Scope; relationship to your Consumer Loan Agreement

This Section 12 governs disputes arising out of or relating to these Terms, the Services, or any other relationship between you and SuprFi. If a dispute is also covered by the Jury Trial Waiver and Arbitration Clause in a Consumer Loan Agreement between you and SuprFi (the “Loan Clause”), the Loan Clause governs that dispute and this Section 12 does not apply to it. A timely opt-out delivered under either this Section 12 or the Loan Clause is effective as to both.

12.2 Mandatory Dispute Notice Process

Before starting arbitration or filing in small claims court, you and SuprFi must complete this process. First, call us at (833) 736-4261. If that does not resolve the matter, mail written notice of the dispute to SuprFi at 1032 E Brandon Blvd #1210, Brandon, FL 33511 within the applicable statute of limitations period, describing the dispute and how you want to resolve it (a “Dispute Notice”). A Dispute Notice must be personally signed by the party sending it, even if that party is represented by counsel. After a Dispute Notice is received, you and SuprFi agree to participate personally and negotiate in good faith for sixty (60) days, including a telephone settlement conference if requested by the receiving party, and SuprFi agrees to toll any applicable statute of limitations, filing fee, or other deadline for that period. Neither party may start arbitration or file in small claims court until it has fully complied with this process, and any arbitration or court proceeding will be enjoined until it is complete.

12.3 Agreement to arbitrate; small claims exception

If the dispute is not resolved through the Mandatory Dispute Notice Process, you and SuprFi agree that it will be resolved by binding individual arbitration. Either party may instead bring an individual action in small claims court within that court’s jurisdictional limits. Arbitration will resolve any dispute a small claims court does not have power to hear, any appeal from a small claims judgment, and any dispute that changes so that the small claims court loses power to hear it.

12.4 Administrator, arbitration demand, and hearing location

After completing the Mandatory Dispute Notice Process, either party may mail the other a demand to arbitrate describing the dispute, the relief sought, and the arbitration group selected; the receiving party must respond within twenty (20) days, and if it does not select as provided, the party sending the demand may select. Arbitration may be administered by the American Arbitration Association, JAMS, or New Era ADR, or by a local attorney, retired judge, or other arbitrator the parties agree on in writing who arbitrates under the consumer dispute rules of one of those groups. The arbitrator will hold any hearing within thirty (30) miles of your home or the transaction location, at the arbitrator’s nearest location to your home, or as the parties agree.

12.5 Class action, representative action, and jury trial waiver

You and SuprFi each waive the right to have a jury resolve disputes, to have courts other than small claims courts resolve disputes, to serve as a private attorney general or in a representative capacity except where that waiver is prohibited, and to participate in a class action as a representative or a member. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. Class arbitration is not allowed.

12.6 Fees, awards, and appeal

SuprFi will advance those filing, administrative, hearing, and arbitrator fees required by applicable law and the arbitration group’s rules, and you will not be required to reimburse them unless the arbitrator determines that your claim is frivolous. Each party pays its own attorney fees and other expenses, except that the arbitrator may award damages, reasonable attorney fees, and expenses where allowed by law. If the amount in controversy exceeds $10,000, either party may appeal the arbitrator’s award to a three-arbitrator panel of the same arbitration group; the appeal will be decided de novo by majority vote, and, subject to applicable law, the appealing party bears the costs of the appeal regardless of outcome.

12.7 Covered borrowers under the Military Lending Act

This Section 12 does not apply to a “covered borrower” under the Military Lending Act, as defined in 32 C.F.R. § 232.3(g), and nothing in these Terms applies to a covered borrower to the extent inconsistent with the Military Lending Act.

12.8 Your right to opt out

You may opt out of this Section 12 by mailing written notice to SuprFi at 1032 E Brandon Blvd #1210, Brandon, FL 33511 within sixty (60) calendar days after you first accept these Terms, stating that you “opt out” and giving your name, address, account number if any, and the date. Opting out will not affect any other provision of these Terms or your use of the Services. An opt-out delivered under the Loan Clause within its own opt-out period is also effective as to this Section 12, and an opt-out under this Section 12 is effective as to the Loan Clause for any agreement you sign within that period.

12.9 Public injunctive relief

A claim for public injunctive relief will not be arbitrated. If you bring a claim seeking public injunctive relief and a court determines, after all appeals are exhausted, that the restrictions in this Section 12 are unenforceable as to that claim, the claim for public injunctive relief will be decided in court and any individual claims seeking monetary relief will be arbitrated. In that case, the parties agree that the court will stay the claim for public injunctive relief until the arbitration award on individual relief has been entered in court. This Section 12.9 is severable from the remainder of this Section 12; a determination that a claim for public injunctive relief must proceed in court does not invalidate the agreement to arbitrate as to any other claim.

12.10 Effect if the class waiver is unenforceable

The class and representative action waiver in Section 12.5 is an essential part of this Section 12. Unless reversed on appeal, if a court invalidates that waiver, the agreement to arbitrate in this Section 12 is void, neither party may compel the other to arbitrate, and disputes will be resolved in court as provided in Section 13 — but the waiver of trial by jury survives, so that only a judge and not a jury will resolve those disputes. Class arbitration will not be allowed. If any other provision of this Section 12 is found unenforceable, it will be severed and the remainder of this Section 12 will continue in effect.

12.11 Governing law of this Section

This transaction involves interstate commerce, and the Federal Arbitration Act governs this Section 12. If a court finds that the Federal Arbitration Act does not apply and that finding cannot be appealed, the law of your state of residence governs this Section 12. The arbitrator must apply substantive law consistent with the Federal Arbitration Act and must honor statutes of limitation and claims of privilege.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict of laws principles. Any legal action not subject to arbitration will be brought in the state or federal courts located in Palm Beach County, Florida, except where a different location is required by applicable law, and you and SuprFi consent to the jurisdiction of those courts. Nothing in this Section deprives you of the protection of any mandatory consumer protection law of the state in which you reside.

14. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason not prohibited by applicable law. If you have an outstanding loan, we will continue to provide the account access necessary for you to view your balance, make payments, and receive required disclosures. Suspension or termination of your access does not cancel your loan, does not relieve you of any obligation to repay amounts you owe, and does not affect any right you have under your Loan Documents. We will continue to provide the servicing communications, disclosures, and account access required by law and by your Loan Documents, including your ability to confirm or dispute a merchant’s completion of goods or services within the period provided in your Consumer Loan Agreement.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date and post the revised Terms. It is your responsibility to check these Terms periodically for changes. Changes are effective when posted, except that material changes take effect thirty (30) days after we notify you of them by email, text message, or another method reasonably designed to reach you. We may provide disclosures and notices required by law and other information about the Services by email, text message, phone call, or by posting notices on our website. Your continued use of the Services after the effective date constitutes acceptance. Changes to these Terms do not amend your Loan Documents.

Section 12 (Dispute Resolution) is an exception: we will not amend Section 12 by posting a revised version. Any change to Section 12 requires an agreement signed or otherwise expressly accepted by you, and no change to Section 12 applies to any dispute of which either party gave notice before the change.

16. General

These Terms and our Privacy Policy, available at www.suprfi.com/privacy, are the entire agreement between you and SuprFi regarding the Services and do not supersede or modify your Loan Documents. If any provision is held unenforceable, the remaining provisions continue in effect and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure or delay in enforcing any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, financing, or sale of assets. We are not liable for failure or delay caused by events beyond our reasonable control. Sections 2, 7, 8, 9, 10, 11, 12, 13, 14, and 16 survive termination of these Terms or your use of the Services.
